On the very first night of coverage of the Supreme Court’s decision on the Affordable Care Act, we pointed out “The Mistake” by the dissent on The Young Turks. They accidentally left at least 15 references to the “dissent” in the case when referring to Justice Ginsburg’s concurringopinion. This indicated that Justice Roberts switched late in the process so that Justice Ginsburg’s opinion changed from the dissent to the concurring opinion when she became part of the winning side of the argument.

“The U.S. Chamber of Commerce is undefeated at the Supreme Court this term, continuing to improve its success in securing business-friendly judgments since Chief Justice John Roberts took the bench in 2005. The Constitutional Accountability Center, a left-leaning think tank and law firm, reported its findings on Thursday, noting that this term, which began in October and will likely conclude by the end of June, could be the chamber’s “first ‘perfect’ term before the Supreme Court since at least 1994.” This term’s “string of seven straight victories brings the chamber’s overall win/loss rate before the Roberts Court up to 68 percent (60 of 88 cases),” wrote Neil Weare, the center’s litigation counsel and Supreme Court fellow. The individual mandate in the health care law wasoriginally proposed by the Heritage Foundation, the most conservative think tank in the country. It was supported by almost every Republican in the country,including the first President Bush, Mitt Romney and conservative stalwarts like Orrin Hatch. Simply put, it was a conservative idea. There is no question about that; it is a fact.

The U.S. Chamber of Commerce sounds like a nice, friendly civic organization. But it’s actually a super PAC throwing a ton of money at attack ads on Democrats and progressive causes. FireDogLake.com’s David Dayen joins Cenk to talk about the group’s staggering win rate when petitioning the Supreme Court on behalf of a cause. Cenk says, “We have the court finally getting to a point where they say, we’ve got this thing on lockdown. We don’t even have to pretend to be fair.” Dayen says, “A lot of people think of the court in terms of social issues — in terms of abortion or gun control. But really what we’ve seen especially in the Roberts era is that it’s a corporate court. It’s a court that takes the side of corporate interests over the individual time after time.” 

Cenk busts out of his “Rage Cage” to point out to the 77 percent of Americans who say they’d want a new health care system proposed to replace the Affordable Care Act if it is struck down by the Supreme Court. “Do you really think the Republicans are going to do anything about it? It makes me so angry that there’s this misinformation out there that the Republican party would do a replacement [of ACA]. They’ve never proposed any fix of this system. It’s not like they didn’t have enough time. They don’t want to do it. Anytime health care reform is proposed, the Republicans knock it down.”
